Fourth U.S. state governor orders net neutrality in government contracts

On Thursday, Phil Scott of Vermont became the fourth governor in the United States to sign an executive order requiring all companies providing Internet access to state agencies to abide by net neutrality for all customers in his state. He said he did this because Vermonters rely on Internet access without blocking, throttling and paid prioritization, threatened by the December 14 decision of the US Federal Communications Commission (FCC) in the matter of “Restoring Internet freedom”. The first state governor to challenge the FCC in this way was Steve Bulllock of Montana, who did so on January 22. Andrew Cuomo of New York followed two days later. Philip Murphy of New Jersey signed a similar executive order on February 5. These four executive orders differ in details, but all require that state agencies purchase Internet access services only from companies with an enforceable commitment to net neutrality for all customers in their state.

This is part of a flurry of state-level net neutrality actions. The New York State Assembly introduced bill A01958 on January 17, 2017, three days before the inauguration of Donald Trump as President of the United States, anticipating action by him to overturn the 2015 “Title II Order” that made net neutrality enforceable in the US. Two other bills were introduced into the Washington House of Representatives in the ten days before the official decision of Trump’s FCC on this issue. In addition to these, 63 other state-level responses by net neutrality supporters were documented by Fight for the Future (FFTF) by February 16, 2018, including at least 27 bills introduced into the legislatures of 17 states with others reportedly under consideration.

These bills are in addition to the lawsuit filed on January 16 by the Attorney General of New York on behalf of 21 states and the District of Columbia claiming this FCC decision was “arbitrary, capricious, and an abuse of discretion within the meaning of the Administrative Procedure Act” (APA) of 1946 and other grounds. These states were New York, California, Connecticut, Delaware, Hawaii, Illinois, Iowa, Kentucky, Maine, Maryland, Massachusetts, Minnesota, Mississippi, New Mexico, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, Virginia, and Washington state. New Jersey reportedly later committed to join the suit.

These four executive orders are the only actions on FFTF’s list of actions by net neutrality supporters that seem immediately enforceable. All others require approval by democratic bodies. The four executive orders might be challenged in courts as conflicting with “Preemption authority” claimed by the US Federal Communications Commission’s “Declaratory ruling, report and order” adopted December 14 and released January 4. The FCC order was described by dissenting Commissioner Clyburn as “Destroying Internet Freedom” rather than “Restoring Internet Freedom” as the order is titled. She wrote that this order “will put profits and shareholder returns above what is best for” consumers.

Kofi Annan, Secretary General of the United Nations, has sent out a plea for more aid for regions of Pakistan affected by this month’s devastating earthquake. He fears thousands could die if aid does not arrive soon.

The death toll from the earthquake is already feared to be at least 79,000.

“…Unlike some natural disasters, in which victims die immediately, the death toll in Pakistan is not over yet,” Annan says. “An estimated three million men, women and children are homeless. Many of them have no blankets or tents to protect them against the merciless Himalayan winter. That means a second, massive wave of death will happen if we do not step up our efforts now.

Helicopters and trucks are of the greatest need.

“The money to pay for those things has been lacking”, said Annan.”So far, we have received firm commitments for only 12 per cent of our appeal. That is $37 million US out of the $312 million that we need.”

During the massive relief effort for the Dec. 26 tsunami 80 percent of the appeal was filled in 10 days.

A major donor conference has been called for next week by Annan. He hopes it will help speed up aid.

“There are no excuses,” Annan also said. “If we are to show ourselves worthy of calling ourselves members of humankind, we must rise to this challenge.”

Emergency relief co-ordinator Jan Egeland said today that NATO needs to organize a massive air-lift if it wants to save lives.The evacuation needs to take place before winter sets in. The main taget would be small isolated villages.

NATO has been air-lifting in aid every day from it’s base in Germany. Another “air brigade” was added recently from Turkey.

The major airlift is needed “to get supplies in and people out,” Egeland told CBC News on Thursday.In order to shelter everyone who is homeless they need, “350,000 tents, which is a mind-boggling number, more than we know exist in the world, are needed…” “We have emptied all of our warehouses.”

Feeling the need to prevent the feared second wave of death, rescuers are in the process of making hard decisions. Aid workers have decided that, this weekend, the focus will switch from treating 87,000 injured to getting aid to the homeless.

“It’s a tough call but we have to face the fact that we’re going to save more lives by getting tents, shelter, food, and supplies up to the people who have nothing [rather] than continuing to bring the injured down,” said Capt. Edward Parsons, with the UN’s Humanitarian Relief Operation in Pakistan

Helicopters are “double tasking” in their trips to small villages. They drop off supplies then pick up the injured.However, the method is proving time-consuming, the need to speed up inward air-lifts is growing.

On Friday, the World Health Organisation (WHO) stated the West African Ebola outbreak is now an international health emergency.

The current ongoing outbreak of Ebola is the deadliest since the disease was first reported in humans 40 years ago, with nearly 1,000 people reported to have been killed by the disease in this outbreak. So far three countries, Sierra Leone, Liberia, and Nigeria, have declared national emergencies in response to the outbreak, with cases also reported in Guinea. The latter country was reported to have closed its borders with Sierra Leone and Liberia, but an official announcement later clarified they were taking medical precautions on border crossings.

Director-General of WHO Dr Margaret Chan appealed for an international response to the outbreak, calling it “the largest, most severe and most complex outbreak in the nearly four-decade history of this disease”. Reports say the comparatively underdeveloped medical infrastructure in the affected countries has hampered efforts to contain the spread of the virus, with Liberia’s health system particularly under-equipped for the pressure. Medecins sans Frontieres (MSF) said the health system in Liberia was “falling apart”. Health experts and aid workers from Europe and America are already working to help bring the outbreak under control, but MSF and WHO are now calling for more help.

The announcement by WHO has international law implications, and it is expected possible cases will not be allowed to leave the countries affected until it is confirmed they are clear of the virus, with the possibility of travel being denied from any region not meeting the WHO’s guidelines. WHO have also warned all nations should prepare to bring their own nationals back to home territory for treatment if infected by the virus, with cases already returned for treatment to the US and Spain.

WHO vaccine chief Jean-Marie Okwo Bele told [[Agence France-Presse|AFP] ]he expected a possible vaccine against Ebola to start clinical trials next month, stating: “Since this is an emergency, we can put emergency procedures in place […] so that we can have a vaccine available by 2015”. WHO assistant director-general Marie-Paule Kieny admitted, however, to do so the bar set during the testing process would have to be lower, reflecting questions about the ethics of using comparatively untested drugs, and who they should be given to.

Meanwhile, restrictions put in place to limit the spread of the disease are reported to be causing problems among those affected in already impoverished areas. Liberia and Sierra Leone are both reported to have deployed soldiers to limit travel within these countries, with many residents reported to be worried about the effect on their trade and incomes. The Telegraph reported from interviews, there is also resistance to some measures in Liberia, where there is a strong stigma attached to the disease. This has led to many people refusing to report the deaths of family members and hand their bodies over for cremation. There have also been cases of violence towards those seeking to enforce government measures to limit the disease’s spread.

The US state of Florida has repealed an order by the state’s governor to drug test all state employees and new hires to state agencies. The Miami federal court has said that the order is unconstitutional, violating the ban upon ‘unreasonable’ search and seizure.

Last year, Governor Rick Scott ordered 80,000 drug tests on state employees. He is a former health care executive and objects to the ruling against drug testing. “As I have repeatedly explained, I believe that drug testing state employees is a common sense means of ensuring a safe, efficient and productive workforce,” Scott said yesterday.

Howard Simon, executive director of the A.C.L.U. of Florida, said, “The governor can’t order the state to search people’s bodily fluids for no reason.”

Governor Scott is also dealing with a drug testing-related lawsuit for recipients of welfare.

Eben Moglen, Columbia University Law Professor, will head the newSoftware Freedom Law Center (SFLC). An initial 4 million dollars has been provided by Open Source Development Labs (OSDL) to fund the project.

The law center will provide free legal service for open source projects and developers. In 2004 OSDL established a separate $10 million Linux Legal Defense Fund providing legal support for Linus Torvalds, Linux kernel creator and end user companies subjected to Linux-related litigation by the SCO Group. The new law center will not be affiliated with the OSDL.

“This is about taking care of the goose that laid the golden egg and not letting wolves come in the middle of the night and steal it away,” Moglen said during a press conference. “This is a legal firm not involved so much in litigating and defending as it will be for counseling and advising and nurturing non-profits and to prevent millions of dollars in litigation.”

Moglen will serve as chairman and director-counsel of the non-profit organization. Also on board as directors are: Lawrence Lessig, law professor at Stanford Law School; Daniel Weitzner, director of the World Wide Web Consortium‘s technology and society activities; and Diane Peters, general counsel at the OSDL. Daniel Ravicher, executive director of the Public Patent Foundation, will help manage as legal director.

Moglen, one of the world.s leading experts on copyright law as applied to software, will run the new Law Center from its headquarters in New York City. The Law Center will initially have two full-time intellectual property attorneys on staff and expects to expand to four attorneys later this year. Initial clients for the Law Center include the Free Software Foundation and the Samba Project.

Other services provided by the SFLC include: asset stewardship, to avoid intellectual property claim conflict; license review and compatibility analysis; legal consulting and lawyer training.

As the holidays approach children make numerous requests to their parents for a puppy for Christmas and many of them oblige though not really having any idea of the care and responsibility involved. One of the perhaps easiest and common mistakes made in the care for puppies involves puppy de-worming and feeding puppies.

Feeding the newest edition in the family might seem easier than you think, as they appear to be great eating machines but feeding puppies people (via table) food is the worst thing you can do for your little companion. Puppies are like human babies, they have specific nutritional needs that can t be met with our food. Also considering that a lot of our food is highly processed making even more unsuitable for dogs. Also consider that certain foods, like chocolate, can make them very sick if not kill your puppy. There are numerous pet food products on the market that provides the proper nutritional feeding puppies. And just like us humans, portioning and frequency can create havoc on the newest member of the family. Puppies can grow into adult dogs that have become overweight; develop premature arthritis and joint problems; and even heart disease. Most puppies can get away with eating three times a day, just like us. Adult dogs, depending upon activity level, can get away with two meals a day. But this isn t the only thing that can affect your newest family member. Various worms can affect the absorption of nutrients for their health and well being.

There are several worm varieties as well as parasites that can be transmitted from mother to offspring or acquired at any point thru infected grasses the dog comes in contact with. Some of these parasites develop into worms that not only feed on what the animal has ingested but also will feed on their organs, getting healthy at the expense of their host. Worms like the Whipworm, Hookworms, as well as the more commonly known Tapeworm and Roundworms (which can be a few feet long) work their way out past the intestines, into the bloodstreams and headed to other critical organs in the body eventually leading to death. Because portions of these worms maybe seen outside of the dog s body, it does not mean that they are completely gone. They are able to regenerate provided the head is still intact. Protozoan parasites like the Giardia and Coccidia which are single celled organisms can cause as much damage as the worms.

Although most breeders and pet stores make every attempt to provide the best of medical care for all the puppies in their care including de-worming, there is always a chance of them still having these parasites. Of course, there is no guarantee of this from puppy mills or private parties. Animal shelters, such as the Humane Society checks for and treats puppies and older dogs for worms. A simple procedure is used to check and treat for these parasites. As part of the annual vet visit, a check for any worms or parasites should be performed on your puppy or adult dog. This will pay off in the long run for the health of your companion.

London, England — As Paralympians ready for the Games which are set to open later this week, they have access to a world class fitness center inside the Paralympic Village which is designed to maximise their pre-Game preparations.

According to volunteers staffing the center, instead of being a single large room, as in Beijing, the building has numerous rooms. It, along with the adjacent Village Services Centre, is designed to be converted into a school after the games conclude. Rooms have been structured as a gym, an auditorium, and science laboratories.

Gym equipment is supplied by Technogym, an Italian firm that has supplied gym equipment for the Olympics since 2000. Equipment has been provided not just for for the Fitness Centre, but for gyms at all the Olympic venues. The newest equipment is oriented toward maximum flexibility, allowing athletes to exercise the particular muscles that they most require for their sport.

In addition to the equipment, the Fitness Centre also provides instructors trained in the use of the equipment, the likes of which athletes from many countries have never seen before. There are also a number of instructors available to provide motivational training.

Five people have died and at least 13 are injured after a car plowed into a crowd in front of Het Loo Palace in Apeldoorn, the Netherlands during celebrations of Queen’s Day. At around 11:50 local time a black Suzuki Swift went through barriers erected to separate the onlooking crowd from traffic, subsequently striking a monument. Members of the Dutch royal family watched the incident take place from the open-topped bus. The incident was witnessed by many onlookers and photographers as well by media covering the pageant.

“He came out of nowhere and dragged ten to fifteen people. There is blood everywhere and people being resuscitated,” a photographer following the parade for De Telegraaf said.

At around 12:00, all official activities in Apeldoorn were cancelled. Other Dutch cities have also cancelled or scaled back activities, such as the Radio 538 concert in Amsterdam and all celebrations in Rotterdam. The mayor of Apeldoorn stated that, “A good day has ended as a drama.” Offical Flags throughout the Netherlands have been placed at half-mast. The Queen responded in a video speech and expressed her sympathy for the victims.

During a press conference held at 15:45, police reported that the man, who was still conscious but heavily injured after the accident, had told police that it was a deliberate act. It was also reported that the 38-year-old, a Dutch national, had not been in contact with the police until earlier that day when he was stopped at one of the barriers. He has no prior history of psychological problems and there are no indications that any sort of terrorist group was involved.

The Queen’s Day celebrations, observing the birthday of the Dutch monarch, take place annually on April 30. Citizens of the country traditionally celebrate by holding late-night markets and decorating the streets of the Netherlands in orange bunting, honoring the House of Orange.
