DON’T BE A VICTIM – Customers’Right to Cancel

Since the start of October 2008 new regulations have come into force concerning the rights of a consumer to change his or her mind and back out of a contract.

Turning a blind eye to the new regulations could invoke a fine over 1,000. This penalty can be handed out personally to any directors who ignore their company s inability to apply the new rules.

Spelled out in the Cancellation of Contracts Made in a Consumer s Home or Workplace etc. Regulations 2008, the new rules mean that consumers now have seven days to cancel a contract, providing that:

The contract is worth more than 35

The consumer entered into the contract away from your business premises

As long as a contract is over 35 and made somewhere other than your business premises, customers can back out in the first seven days. They do not have to give any reason at all.

This provision is being called the customer s right to cool off.

Remember, this applies only to contracts made with consumers. They are customers to whom you provide services or sell goods for non-business reasons. These regulations do not apply to any contracts made between one business and another.

What does this mean for my business?

If you make contracts with consumers in this way, then you will need to be aware of their new rights and adjust your paperwork to reflect this. Unlike the Sale of Goods Act, which states that their must be something wrong with goods for them to be returned, these new rules mean that consumers can pull out without having to give a reason. They can cancel the contract without any liability providing they do so within seven days. This applies regardless of whether your visit to the customer is unsolicited or a pre-arranged appointment.

To include the Regulations in your paperwork, give your customers written notice of their right to cancel when the contracts are made. To make it obvious to your customers:

Spell out their right clearly and obviously

Include the date, your company name and contact details

Tell them how to cancel

Include a cancellation form and an address to send it to

Specify that the seven day period begins at the date of this contract

The customer cancellation form need say no more than: To (insert your company name), I/we give notice that I/we wish to cancel my/our contract. Signed

You may want to word the notice in the following way:

Should you wish to cancel this contract, you must do so in writing within seven calendar days from the date of this contract, sending, delivering or emailing your cancellation to the person named below. A cancellation form is included for your convenience or you may write your own cancellation.

The customer s right to cancel prevents them from being unduly pressured into receiving services or goods. Being clear on it as a business is not hard to do, and it prevents you from suffering a large fine for not complying with new regulations.

The European country of Slovakia will have the euro replace the koruna as its official currency, starting January 1, 2009. Slovakia is the sixteenth country to start using the euro. The official conversion rate is set at 30.126 koruna to one euro.

Joaquín Almunia, the European Union Economic and Monetary Affairs Commissioner, stated that the conversion will be “a proud moment for the euro area […] the euro has become the symbol of EU identity and is protecting us against the tremendous external shocks that we have had to cope with since the summer of 2007.”

January 1 also marks the tenth anniversary of the euro being introduced as globally exchangeable currency.

A woman in Tennessee, United States dressed up like a nurse and tried to steal a baby from a hospital’s maternity room but police arrested her. Adriene Johnson, 24, is now in custody after trying to steal the baby. The woman entered the hospital’s maternity room dressed in scrubs and was going to take the baby’s temperature said police.

Security was alerted to Johnson when she tried to take the baby out of the hospital. The room was then locked down and the baby was handed over to the doctor. Johnson was on bond after being arrested by police on Monday. She was also charged with trying to steal a baby’s rocker from a Wal-Mart which she tried to get a refund on.

On Monday, Filipina weightlifter Hidilyn Diaz won the gold medal at the Tokyo Olympics in women’s weightlifting in the 55 kg category during her fourth Olympic games. She lifted a combined weight 224 kg (494 lb), tying the previous new Olympic record. In the snatch she lifted 97 kg (214 lb) and in the clean and jerk 127 kg (280 lb), totaling the 224 kg.

After the match, she said in an interview, “I am 30 years old and I thought it would be like going down, my performance, but I was shocked I was able to do it”. A statement from the Philippines’ presidential spokesman Harry Roque celebrated Diaz’s win, saying, “Congratulations, Hidilyn. The entire Filipino nation is proud of you”.

The previous record-setter Liao Qiuyun of China took the silver medal with a total weight of 223 kg (492 lb), and Zulfiya Chinshanlo of Kazakhstan took the bronze with 213 kg (470 lb).

Diaz won the silver medal during the 2016 Olympic Games in Rio de Janeiro, Brazil, where she competed in the 53 kg category. She won a gold medal in the 2019 Southeast Asian Games. Diaz trained in Malaysia, where she was stuck due to COVID-19 travel restrictions imposed by the Philippines. While there, she trained in a self-built gym, using water bottles.

The interview comes amid tensions in cash-strapped Greece, where the government is introducing controversial austerity measures to try to ease the nation’s debt-problem. An international rescue package has been prepared by European Union member states and the International Monetary Fund – should Greece require a bailout; protests have been held against government attempts to manage the economic situation.

Les Paul, the American jazz guitarist whose eponymous electric guitar remains one of the most popular and influential designs of musical instrument in modern history, has died at the age of 94 of complications from pneumonia.

Born Lester William Polfuss in 1915 in Waukesha, Wisconsin, United States, Les Paul was establishing himself as a jazz musician in Chicago when in 1939 he built “The Log”, reputed to be the first solid-body “Spanish-style” electric guitar ever made. Discussions with Gibson Guitars led to the development of the Gibson Les Paul guitar, which with its unprecedented tonal properties (caused in part by its unprecedented weight) quickly established itself among players of both the emerging rock & roll style of music and the developing electric blues.

Paul was also a pioneer of recording techniques. Paul’s experiments with multi-tracking in the 1940s led to a string of chart successes with songs like “How High The Moon“, in which Paul’s guitar work and then-wife Mary Ford‘s vocals appeared a novel many-layered setting, Paul playing up to eight guitar parts and Ford harmonizing with herself.

Although Paul entered semi-retirement in his 50s, he remained active and performing almost until his death; his last album was released in 2006. Les Paul received a number of accolades throughout his career: he was the recipient of numerous Grammy awards, an inductee into the Rock and Roll Hall of Fame, and the namesake of the Mix Foundation‘s Les Paul Award for “individuals or institutions that have set the highest standards of excellence in the creative application of audio technology.” He was also the subject of two biographical films.

While Les Paul had no children, he is survived by a godson, the guitarist Steve Miller.

Scientists have discovered a place on the outside part of AIDS virus that might be vulnerable to antibodies blocking the virus from infecting human cells. This could mean that an anti-HIV vaccine is possible in the future.

According to Peter Kwong, researcher at U.S National Institute of Health (NIH), this study is likely to contribute to finding HIV’s “site of vulnerability” which could then be targeted with a vaccine that prevents the initial infection.

The team of researchers have made atomic-level images of HIV and revealed the structure of a protein on the surface of the virus. This protein, called gp120, binds to an infection-fighting antibody and seems to be susceptible to attacks by this antibody called ‘b12’. B12 can broadly neutralize the virus.

Researchers detailed the precise interaction as the virus tries to hook on to and infect cells sent to protect the body. They have captured an image of how the virus of human immunodeficiency attacks the human cells. Dr. Gary Nabel, an NIH vaccine expert and a co-author of the research, describes this first contact between the virus and the cells as a ‘cautious handshake’ which then becomes a ‘hearty bear hug’. The virus grabs and infects the cells that are aimed at protecting the body.

Then the virus mutates quickly to fight the immune system’s attacks as well as to counter the effect of antibodies that block the proteins with help of which HIV binds to a cell to infect it.

Scientists agree that a vaccine against AIDS would be an ideal way to stop the pandemic of this disease, but, with all importance of these findings, much work and studies are still needed. This implies that any vaccine against AIDS is probably still many years away.

The AIDS virus has killed more than 25 million people since it was first detected in 1981. Sub-Saharan Africa is the most severely affected by the epidemic. Approximately 40 million people live with HIV.

About a dozen potential vaccines are currently under development. Two products, one by Merck and one by Sanofi-Aventis, are now in advanced human trials.
