A delegation claiming to represent the Lakota Indian Tribe, an Indian nation within United States borders, have signed a document stating that the tribe withdraws and or cancels all treaties with the U.S. and formally establishes independence from the country. The letter was hand delivered by activists for the tribe to Deputy to the Public Liaison at the State Department, Daniel Turner.

“We are no longer citizens of the United States of America and all those who live in the five-state area that encompasses our country are free to join us. This is according to the laws of the United States, specifically article six of the constitution. It is also within the laws on treaties passed at the Vienna Convention and put into effect by the US and the rest of the international community in 1980. We are legally within our rights to be free and independent,” said Russell Means, an activist for Native American rights to reporters at a press conference on Wednesday in Washington, D.C..

“Today is a historic day and our forefathers speak through us. Our Forefathers made the treaties in good faith with the sacred Canupa and with the knowledge of the Great Spirit. They never honored the treaties, that’s the reason we are here today,” said Garry Rowland who is also known as Wounded Knee.

The delegation wrote a formal letter to the Department of State which was hand-delivered by activists of the tribe announcing their secession. So far, the U.S. has not issued a public response regarding their decision. Wikinews attempted to contact the State Department, but in an e-mail Director of the Office of Media Affairs Kirsten Petree stated that “this is not an issue for the State Department” and referred us to the Department of the Interior.

Under the declaration, the tribe, which consists of people from Nebraska, North Dakota, Montana, South Dakota and Wyoming, would create and issue its own driver’s licenses and passports. According to a report by Agence France-Presse, all residents who currently live within Lakota borders can continue to reside there without paying taxes, as long as they renounce their U.S. citizenship.

The attempt to gain independence began in 1974 when activists wrote up a draft declaration of independence, which was modeled after the 1776 Declaration of Independence that the U.S. signed in declaring freedom from England.

Many of the treaties the tribe signed with the U.S. are over 150 years old.

“We have 33 treaties with the United States that they have not lived by. They continue to take our land, our water, our children,” said activist Phyllis Young, who was one of the individuals who helped to organize a 1977 conference in Geneva on “indigenous rights.”

The other members of the activist delegation were Duane Martin Sr., Gary Rowland and Phyllis Young. Duane Martin Sr. is a leader of a group called the Strong Heart Society. Gary Rowland is a leader of a group called the Big Foot Riders. Phyllis Young is the founder of a group called Women of All Red Nations.

Means’ group is based in Porcupine, South Dakota on Pine Ridge Indian Reservation. Means’ group is not an agency or branch of any Lakota tribe, although he ran unsuccessfully for president of the Oglala Sioux tribe in 2006.

The International Watch Company (IWC) is organizing an on-line auction to take place in the period from December 13 to December 20, 2006. The proceeds of the auction will be used for offering support to a charitable organization – Association Vol de Nuit/Vuelo Nocturno. The main task and responsibility of the association lies in taking care of Buenos Aires children who live in reduced circumstances.

Association Vol de Nuit/Vuelo Nocturno, a humanitarian institution, was established in 2003. The Foundation has built close cooperation with the city’s schools, homes and other organizations helping street children. The proceeds of the IWC on-line auction are to be benefited to the major projects carried out by the Foundation.

Da Vinci is the name of a rarity timepiece chosen by the IWC to be put for auction. The watch itself was developed back in 1990 as a part of a limited edition of just 110 pieces. It represents a stainless steel model featuring a white dial in English which is provided with a perpetual calendar function. The exclusive watch is on the list of the most sought-after items among connoisseurs of High Horology.

This is the ninth time the IWC is holding an auction for charitable purposes and every time dozens of watch collectors and enthusiasts take part in the event. The bidders are invited to visit the official site of the Company.

In a unanimous decision, a US federal appeals court issued a ruling Friday against the federal government, in favor of Massey Energy Co, owner of the Upper Branch Mine in West Virginia, the location of last year’s mine disaster that killed 29 workers. The court ruled the company may appeal the restrictions placed on it by a government order hindering the company’s ability to conduct its own internal investigation of the disaster.

The order controlling Massey’s investigations into the disaster was placed on Massey immediately after the incident by the Mine Safety and Health Administration (MSHA) when it seized control of the coal mine six hours after the blast on April 5.

MSHA’s controls prohibited Massey from “taking or retaining photographs, collecting and preserving mine dust samples, employing mine mapping technology, and participating in or objecting to any destructive testing of materials gathered underground.” Massey said MSHA’s restrictions prevented the company from evaluating the accident site before it was altered by investigators, and denied Massey the chance to gather evidence to use in the company’s defense.

Massey’s appeal to the Federal Mine Safety and Health Review Commission (the commission that decides disputes over mining regulations) to void the order by MSHA was denied by the commission. It based its decision on its interpretation of the Mine Act that it had no authority to consider Massey’s appeal. The United States Court of Appeals for the District of Columbia Circuit set aside this decision, finding the commission’s interpretation of the act was “simply untenable” and the government’s actions had denied Massey the opportunity to gather “potentially important exculpatory evidence”.

The court rejected the commission’s position that the Mine Act’s language was ambiguous, allowing the government flexibility in its implementation. Rather, the court said, “No matter how you parse it, [the act] is a model of near-perfect clarity. Indeed, it is hard to imagine a clearer expression of congressional language.” It also rejected the commission’s position that the case was moot: “This case is not moot. Indeed, even the [Labor] Secretary’s counsel recognized the near-frivolity of this argument, and made only a half-hearted attempt to persuade us.”

The court’s ruling comes after a state government-comissioned report issued on May 19 by investigators found Massey Energy responsible for the deaths of the 29 workers. The workers were killed in an explosion that could have been avoided, the report said, if Massey had put in place standard safety procedures.

“The story of Upper Big Branch is a cautionary tale of hubris. A company that was a towering presence in the Appalachian coal fields operated its mines in a profoundly reckless manner, and 29 coal miners paid with their lives for the corporate risk taking,” the report read. “The company’s ventilation system did not adequately ventilate the mine. As a result, explosive gases were allowed to build up.” The report detailed claims Massey threatened miners with termination if they stopped work in areas that lacked adequate oxygen levels and listed numerous other state and federal safety standards that Massey failed to follow. Also blamed in the report was MSHA for failing to enforce federal regulations.

The report was considered by the those in the mining industry as especially direct and “hard hitting”. It firmly rejected conclusions reached by Massey officials that the incident was caused by an unexpected, massive, and uncontrollable methane bubble eruption, an occurrence that Massey said it could neither predict nor manage.

The company immediately challenged the report and issued its own report on June 3, blaming the blast on an act of nature and denying the company’s safety culture was at fault. MSHA also have an as-yet unreleased report in the works.

Wikinews on Sunday interviewed Deepa Malik, India’s first female Paralympic medalist, who won the silver medal in the Women’s Shot Put F53 event finals, at the 2016 Summer Paralympics being held in Rio de Janeiro, Brazil.

Malik lost the gold medal to Bahrain’s Fatema Nedham, who had the best throw 4.76 metres, setting a new regional record in paralympic women’s shot put.

Arriving in Rio, Malik had initial trouble due to the airline losing her luggage; it didn’t all arrive until three days later: clothes, opening ceremony outfit and equipment including competition belts.

In early August there was a possibly that Malik might lose her spot on the Indian team going to Rio, with fellow female para athlete Karam Jyoti challenging Malik’s selection and the Sport’s Authority of Indian’s selection process at the High Court of Delhi. The high court ruled against the plaintiff.

Both of these events occurred against the wider backdrop of the Paralympic Committee of India being suspended by the International Paralympic Committee. The Sports Authority of India took final authority over the Paralympic Committee of India for sending a team to Rio, with agreement from the International Paralympic Committee; this arrangement allowed India to compete under their own flag at the 2016 Summer Paralympics.

((Wikinews)) Congratulations on your result.

Deepa Malik: Thank you so much.

((WN)) Even though you are currently waiting in terms of the end result of the protest.

DM: Absolutely, but I’m happy with my performance, I’m happy that I could improve and I could prove myself, there were a lot of questions back home on my selection and on my hard work. My single-minded focus that I had put into this journey of being a Paralympian. Well, I am just so anxious about the results.

((WN)) So how much did the court case and KLM losing your luggage impact on your preparations and your result today?

DM: Yes, but I’m happy that my husband was my coach here, and, so, I had huge moral support in terms of keeping my mind and everything in peace. Most of the equipment was available in the gym, we had to alter the training a bit like the throw days couldn’t happen, so we instead exercised. No, I think that is what sports teaches you, you can’t live on excuses, I never lived on excuses.

((WN)) You work around things.

DM: Yes, that’s what we do, that’s what a sportsman is suppose to do, rise again, and then fall and rise, and run, and I did exactly that.

((WN)) What message should other Indian women take away from your participation and result in Rio?

DM: This is going to be the first female medal that India would have ever won in Paralympics and as it is I’m working aggressively towards transforming this entire concept of empowerment for the women, especially the women in disabilities in my country. So I’m really happy that this medal give my voice more value, more strength, and I’ll be able to impact even more, though on the ninth of September the Prime Minister’s jury has awarded me with the award of Women Transforming India, I’m so happy that within three days of getting that award, I have added another feather to it and proved that yes this journey of ability beyond disability. And not just disability, this is a universal message that if women put their minds to their dreams they can balance it; age, gender, disability, is all a state of mind. If you put your passion and hard work, you can get it, and in the Indian scenario were they say infrastructure is a challenge, women participation that are taboo, religiously and psychologically, disabilities taken as a curse, dependability[?] increases because of lack of infrastructure, well, time to get rid of the excuses. We have to start erasing the excuses and believe your own self and that’s the message I’m carrying with all the activities that I do whether it is car rallying, motorbiking or swimming across a river, every record or every unique activity that I’ve undertaken and just below paralysis has been aimed at changing the stereotypical image of a women and also a women in disability. ?

((WN)) Will you and your daughter both be trying to represent India at the 2020 Games in Tokyo?

DM: I’m very sure about myself, but my daughter, though, she’s a Paralympian, yes, which again was considered a huge taboo in my society that oh my god both the mother and the daughter both have a physical disability, what is going to happen to these two, but we did good and she is working as a youth council representative in the Commonwealth countries, for the Paralympics specially, and her work though her foundation called Wheeling Happiness has earned her the young leader award from the Queen of England, so I guess her focus is now shifting to more on community service and empowering others and not just herself. And she is leaving on first of October to Loughborough to do her PhD doctorate programme in disability sports psychology, I’m very sure Loughborough is going to give her a huge amount of sports [inaudible] but how much time she going to decide to devote to sports and studies is her decision entirely. That’s her dream, her journey. 

((WN)) How helpful was the Sports Authority of India in preparing and supporting your Rio ambitions??

DM: I think 100 per cent, because the biggest challenge we have back home is a customised training, or the infrastructure for that matter, so we were given the ability and the funds to train the way we wanted to train, and the funds were huge which were given to us, out accommodation, food, diet, physical therapist, psychologist, trainer, gym, everything was paid for, and customised, you want it and they give it. So I guess this was easy financially this time, because every expenses was taken care of, my husband could also take a sabbatical from his job and join my journey, and having him twenty-four seven and coaching me because he himself is an athlete, and have the best diet and counselling. I think it’s worked wonders, so I give shout out and a huge applaud.

((WN)) How important was it for you to have a carer in Rio?

DM: Yes, again we really have to appreciate the sports authority of India and also Paralympic Committee of India, which is going to start to function post-Rio in India. They were very very quick, they were very very adamant in giving the wheelchair people escorts. And I need help twenty four seven, I’m just below paralysed so it was really huge, emotionally, mentally, psychically training-wise, every way I think the situation was perfect.

Ian Narev, the CEO of the Commonwealth Bank of Australia, this morning “unreservedly” apologised to clients who lost money in a scandal involving the bank’s financial planning services arm.

Last week, a Senate enquiry found financial advisers from the Commonwealth Bank had made high-risk investments of clients’ money without the clients’ permission, resulting in hundreds of millions of dollars lost. The Senate enquiry called for a Royal Commission into the bank, and the Australian Securities and Investments Commission (ASIC).

Mr Narev stated the bank’s performance in providing financial advice was “unacceptable”, and the bank was launching a scheme to compensate clients who lost money due to the planners’ actions.

In a statement Mr Narev said, “Poor advice provided by some of our advisers between 2003 and 2012 caused financial loss and distress and I am truly sorry for that. […] There have been changes in management, structure and culture. We have also invested in new systems, implemented new processes, enhanced adviser supervision and improved training.”

An investigation by Fairfax Media instigated the Senate inquiry into the Commonwealth Bank’s financial planning division and ASIC.

Whistleblower Jeff Morris, who reported the misconduct of the bank to ASIC six years ago, said in an article for The Sydney Morning Herald that neither the bank nor ASIC should be in control of the compensation program.

A car containing a bomb was discovered in Times Square, New York City, causing the evacuation of streets surrounding the area.

Reports say the vehicle, a Nissan Pathfinder, parked outside a theatre on 45th Street and Seventh Avenue, had smoke coming out of the back at around 6:30 p.m EDT (10:30 p.m. UTC). Unconfirmed reports say an unknown man ran away from the car. A roughly square area of the city, its boundaries formed by 43rd and 48th Street and 7th and 8th Avenue, was evacuated.

The New York Police Department bomb squad was called in and were able to retrieve the package using a robot. Officials removed gunpowder, consumer-grade fireworks, two five-gallon cans of gasoline, three propane tanks, electrical wiring, and two clocks with batteries that apparently were fashioned as one or two detonators. The bomb has been described as “amateurish”. No casualties or injuries were reported.

As of yet police have not named a suspect and are reviewing security footage. The car used by the suspect was stolen and had a non-matching license plate; the legitimate owner of the plates does not appear to have been involved in the incident.

President Barack Obama has congratulated the speediness with which the New York Police Department responded.

New York has been in a state of constant alert since the attacks that occurred on September 11, 2001. In September 2009, a plot to attack the New York Subway with suicide bombers was uncovered by police. In December 2009, Times Square was evacuated due to a illegally parked van, although it contained no explosives. On March 6, 2008, a small bomb was set off in front of the United States armed forces recruiting station in Times Square.

Torture proliferates American headlines today: whether its use is defensible in certain contexts and the morality of the practice. Wikinews reporter David Shankbone was curious about torture in American popular culture. This is the first of a two part series examining the BDSM business. This interview focuses on the owners of a dungeon, what they charge, what the clients are like and how they handle their needs.

When Shankbone rings the bell of “HC & Co.” he has no idea what to expect. A BDSM (Bondage Discipline Sadism Masochism) dungeon is a legal enterprise in New York City, and there are more than a few businesses that cater to a clientèle that wants an enema, a spanking, to be dressed like a baby or to wear women’s clothing. Shankbone went to find out what these businesses are like, who runs them, who works at them, and who frequents them. He spent three hours one night in what is considered one of the more upscale establishments in Manhattan, Rebecca’s Hidden Chamber, where according to The Village Voice, “you can take your girlfriend or wife, and have them treated with respect—unless they hope to be treated with something other than respect!”

When Shankbone arrived on the sixth floor of a midtown office building, the elevator opened up to a hallway where a smiling Rebecca greeted him. She is a beautiful forty-ish Long Island mother of three who is dressed in smart black pants and a black turtleneck that reaches up to her blond-streaked hair pulled back in a bushy ponytail. “Are you David Shankbone? We’re so excited to meet you!” she says, and leads him down the hall to a living room area with a sofa, a television playing an action-thriller, an open supply cabinet stocked with enema kits, and her husband Bill sitting at the computer trying to find where the re-release of Blade Runner is playing at the local theater. “I don’t like that movie,” says Rebecca.

Perhaps the most poignant moment came at the end of the night when Shankbone was waiting to be escorted out (to avoid running into a client). Rebecca came into the room and sat on the sofa. “You know, a lot of people out there would like to see me burn for what I do,” she says. Rebecca is a woman who has faced challenges in her life, and dealt with them the best she could given her circumstances. She sees herself as providing a service to people who have needs, no matter how debauched the outside world deems them. They sat talking mutual challenges they have faced and politics (she’s supporting Hillary); Rebecca reflected upon the irony that many of the people who supported the torture at Abu Ghraib would want her closed down. It was in this conversation that Shankbone saw that humanity can be found anywhere, including in places that appear on the surface to cater to the inhumanity some people in our society feel towards themselves, or others.

“The best way to describe it,” says Bill, “is if you had a kink, and you had a wife and you had two kids, and every time you had sex with your wife it just didn’t hit the nail on the head. What would you do about it? How would you handle it? You might go through life feeling unfulfilled. Or you might say, ‘No, my kink is I really need to dress in women’s clothing.’ We’re that outlet. We’re not the evil devil out here, plucking people off the street, keeping them chained up for days on end.”
